The present Terms and Conditions are to set the terms for services being provided by WDXPERIENCE, LDA. through the Wine XP booking platform (website and APP), whose headquarters are Rua Circular Norte, Parque Industrial e Tecnológico de Évora, Edifício NERE, 7005-841 Évora with the fiscal ID n.º 516.115.677, and a company capital of 5.000€ (five thousand euros).
The service consists in making available, through the Wine XP booking platform, information with regards to products and services made available by wineries in Portugal and allows a user to book wine experiences according to these Terms and Conditions indicated below.
All of the “wine experiences” sold on the Wine XP booking platform are available once confirmed by the wineries and subject to existing stock or availability at the winery.
Prices
1.1 All indicated prices are in Euros with IVA included at the Portuguese legal rate (23%).
1.2 The indicated prices are valid unless there is a programming, typographic, or updating of the services and systems.
1.3 A Wine XP reserves the right to modify at any moment the information and commercial offer presented regarding the wine experiences, prices or commercial conditions.
Reservations
2.1 When booking a wine experience on Wine XP, the user will receive his booking confirmation once the winery has confirmed.
2.2 Wine XP will assume no responsibility for any delay in confirmation nor in the non-availability of the wine experience at the time.
2.3 When reserving the customer pays 100% of the value of the total of the “wine experience”.
Payments
3.1 All payments shall be made to Wine XP and no money transfer or direct payment should be made to any other person or entity.
3.2 Wine XP only guarantees the security of the payment if it is made through its platform.
3.3 The invoice related to the payment is available on the Wine XP site/APP and available to the registered customer.
Not being able to provide the Wine Experience or substitution
4.1 If there is a temporary or definitive unavailability of the wine experience, the user will be informed and where possible be offered a similar alternative with similar characteristics to the chosen and purchased wine experience.
4.2 If this substitution is not possible, the amount paid will be refunded in its totality to the customer /user without any additional costs or the payment will be cancelled in the case of Multibanco.
Cancellation Policy
5.1 If you cancel more than 7 days before the date of your experience, there is no cancellation fee.
5.2 Cancellation less than 7 days and until 2 days before the date of your experience: 50% of the total booking price will be charged which will be the cancellation fee.
5.3 For Cancellations within/less than 2 days of the date of your experience, there is a 100% cancellation fee.
Maximum Capacity
6.1 Each wine experience has a maximum number of participants.
6.2 The indicated maximum number refers to the maximum number of adults (and children where applicable) per experience.
Means of payment
7.1 Mastercard, Visa, MBWay and Multibanco
The images presented on this booking platform (site and APP) are merely illustrative and could, at times, not correspond with the reality of the wine experience.
The Decreto-Lei n.º 74/2017, of 21 June, (regulated by Portaria n.º 201-A/2017), created an online Complaints book, which is available on www.livroreclamacoes.pt (Digital Platform), which allows consumers and users, to present any complaints in the same way as if they were presented in physical paper format.
The present agreement is subject to Portuguese Law.
Any dispute resulting from the interpretation or execution of any purchase made on Wine XP will be submitted to the Comarca of Lisbon Tribunal/Courts, with the expressed waiver of any other jurisdiction.
When using the Wine XP booking platform (site or APP), you agree with the Terms and Conditions. If these Terms and Conditions are altered, these will be published through a new consolidated version on the Wine XP booking platform (site or APP).
